1Agreement to these terms
These Terms of Service (“Terms”) govern your access to and use of Embirea's websites, apps and services (the “Service”). By creating an account, accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Embirea.
2Who can use Embirea
You must be at least 16 years old (or the age of digital consent in your country) and able to form a binding contract. You're responsible for your account and for keeping your login secure. Everything done through your account is treated as done by you. Tell us promptly at [email protected] if you suspect unauthorised use.
3What Embirea is (and isn't)
Embirea is a planning and coordination platform. We help you build itineraries, pool a shared travel fund, get local tips, and discover and book offers from independent local suppliers. Embirea is not an airline, hotel, tour operator, travel agent of record, bank or payment institution. When you book a supplier, your travel contract is with that supplier; when you move money, the regulated payment provider handles it.
4The travel fund and payments
The travel fund lets you and your crew set money aside and pay for trip items. Wallet linking and money movement are provided by Revolut and PayPal under their own terms, which you also agree to when you link a wallet. You authorise contributions, top-ups and bookings that you initiate. You're responsible for ensuring you have sufficient funds and for any provider fees, currency conversion, taxes or charges that apply.
Refunds for a booking follow the relevant supplier's cancellation policy and the payment provider's process. Embirea may show a ledger and settlement summary for convenience, but the underlying funds are held and moved by the providers, not by Embirea.
5Bookings with suppliers
Listings, prices, availability, opening hours and deals are provided by suppliers or third parties and can change. We work to keep them accurate but don't guarantee them. When you book, you enter a contract directly with the supplier and accept their terms, including their cancellation and refund rules. Any dispute about a booking is primarily between you and the supplier; we'll help where we reasonably can.
6Your content
You keep ownership of the content you create - itineraries, articles, reviews, photos and comments (“Your Content”). By posting it, you grant Embirea a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt and distribute Your Content for the purpose of operating and promoting the Service. This licence ends when you delete Your Content, except for copies retained in backups or where others have already re-used content you made public.
You represent that:
- You own or have the rights to post Your Content.
- It doesn't infringe anyone's rights or break the law.
- Reviews reflect a genuine experience and aren't paid for or fake.
We may review, moderate, refuse or remove content that breaches these Terms, but we're not obliged to monitor everything posted.
7Suppliers and partners
If you register a business, publish listings, or use the Supplier API, additional partner terms apply alongside these Terms. You're responsible for the accuracy and legality of your listings, for honouring bookings made through Embirea, and for keeping your API keys secret. We may suspend partner access for breach, fraud, or repeated traveller complaints.
8Acceptable use
You agree not to:
- Break the law or infringe others' rights, privacy or intellectual property.
- Post false, misleading, abusive, hateful or fraudulent content or reviews.
- Attempt to access accounts, data or systems you're not authorised to use.
- Scrape, overload, reverse-engineer or interfere with the Service or its security.
- Use the Service to launder money, fund illegal activity, or evade sanctions.
- Misuse the travel fund or payment features, or initiate fraudulent chargebacks.
9Intellectual property
The Service, including the Embirea name, logo, design, software and content we provide, is owned by Embirea or its licensors and protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Service under these Terms. You may not copy, modify, distribute or create derivative works from it except as the law allows or we expressly permit.
10Third-party services
The Service integrates third parties - for example Google Maps for mapping, Revolut and PayPal for payments, and an AI model provider for the assistant. Your use of those features may be subject to the third party's terms, and we're not responsible for their services, content or availability.
11Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. Travel information - including tips, opening hours, routes, prices and supplier deals - is provided as guidance and may be incomplete or out of date. Always confirm critical details (visas, flights, opening times, safety) with the official source. We don't warrant that the Service will be uninterrupted, secure or error-free.
12Limitation of liability
To the fullest extent permitted by law, Embirea and its officers, employees and partners won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, goodwill, or travel costs, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the fees you paid Embirea in the 12 months before the claim, or €100. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Statutory consumer rights remain unaffected.
13Indemnity
You agree to indemnify and hold Embirea harmless from claims, losses and expenses (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, or content you post.
14Suspension and termination
You can stop using Embirea and delete your account at any time. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure, or if we discontinue the Service. Provisions that by their nature should survive - such as content licences, disclaimers, liability limits and governing law - survive termination.
15Governing law and disputes
These Terms are governed by the laws of Greece, without regard to conflict-of-laws rules, and the courts of Athens, Greece have jurisdiction - except where mandatory consumer- protection law in your country of residence gives you the right to bring proceedings locally, which we respect. We'd always rather resolve things informally first, so please contact us before starting formal proceedings.
16Changes to these terms
We may update these Terms from time to time. We'll update the “last updated” date and, for material changes, give reasonable notice. Continuing to use the Service after changes take effect means you accept the updated Terms.
